Terms of Service

Overview

These Terms of Service ("Terms") govern your use of LeedIQ's lead list and direct mail services ("Service"). By subscribing to or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

"LeedIQ," "we," "us," and "our" refer to the company operating under the LeedIQ brand. "Client," "you," and "your" refer to the licensed pool builder, contractor, or business that subscribes to the Service.

Who may use the Service

The Service is available to licensed pool builders, pool contractors, and related home improvement businesses operating in Florida. By signing up, you represent that:

• You are operating a legitimate, licensed business
• You have the authority to enter into this agreement on behalf of your company
• You will use the lead list solely to market your own pool-related services

What the Service includes

Lead list access: A monthly list of recently sold single-family homes in your selected Florida market(s) that do not appear to have a pool, scored and ranked by purchase recency, sale price, lot size, and year built. Lists are updated continuously as new sales are recorded.

Direct mail fulfillment (optional add-on): On your instruction, we will print and mail First Class USPS postcards to homeowners on your list. Postcards are sent in your company's name. You are responsible for reviewing and approving all postcard artwork before mailing. We do not mail without your explicit approval.

What the Service does not include: We do not make sales calls, manage your CRM, guarantee any specific response rate, or promise a certain number of pool contracts. Lead lists are a marketing tool — results depend on your follow-up, pricing, and service quality.

Pricing and billing

Subscription fee: Your selected monthly plan is billed in advance on a recurring basis. The subscription covers access to your lead list for that month.

Postcard fee: $1.00 per postcard printed and mailed via USPS First Class Mail. Postcard orders are billed separately at the time of the mailing instruction.

Price changes: We will give you at least 30 days' written notice before changing your subscription price. Postcard pricing may change with 14 days' notice.

Failed payments: If a payment fails, we will attempt to notify you and retry. Service access may be suspended after 7 days of non-payment.

30-day money-back guarantee

New subscribers may request a full refund of their first month's subscription fee within 30 days of their first charge, for any reason. The guarantee applies to the subscription fee only — postcard printing and postage costs are non-refundable once a mailing has been submitted. To request a refund, email info@leediq.com.

Cancellation

There are no long-term contracts. You may cancel your subscription at any time by emailing us. Cancellation takes effect at the end of your current billing period — you retain access and your list through the period you've already paid for. We do not issue prorated refunds for cancellations mid-period (except under the 30-day guarantee above).

Your responsibilities

• Lawful use: You agree to use lead data solely to market your own pool services. You may not resell, sublicense, or share the lead list with any third party.
• Do Not Mail compliance: If a homeowner contacts you directly to request no further mail, you must honor that request. You may also notify us and we will add the address to our suppression list.
• Postcard content: All postcard content you submit must be accurate, not misleading, and comply with applicable advertising laws. We reserve the right to refuse to mail content we determine to be deceptive or unlawful.
• Accurate account information: You are responsible for keeping your billing and contact information up to date.

Intellectual property

The lead lists, scoring methodology, software, and all related materials produced by LeedIQ are our proprietary property. Your subscription grants you a limited, non-transferable license to use the lead data for your own direct marketing during the subscription period. You acquire no ownership rights in the data or our systems.

Any postcard artwork or content you provide to us for mailing remains your property. By submitting it, you grant us a limited license to print and mail that content on your behalf.

No warranty on results

The Service is provided "as is." We warrant that the lead data is sourced from public county property appraiser records and is processed in good faith. We do not warrant that every property on the list is truly without a pool — public records occasionally lag behind new construction or are incomplete. We do not guarantee any specific number of responses, consultations, or closed sales.

Limitation of liability

To the fullest extent permitted by law, LeedIQ's total liability to you for any claim arising from the Service shall not exceed the amount you paid us in the 3 months immediately preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, even if we have been advised of the possibility of such damages.

Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute that cannot be resolved informally shall be submitted to binding arbitration in Sarasota County, Florida, under the rules of the American Arbitration Association.

Changes to these Terms

We may update these Terms from time to time. We will notify active clients by email at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
